A) 500 Flats: Rs. 5 – 10 Lakhs Each.

B) In 2010 the building was demolished as it was constructed on reserved government land.

C) Money was collected from more than 500 flat buyers. Money not refunded. Hundreds of legal cases ongoing. No action on FRI lodged in 2011.

NCDRC penalises Trishul Builders, partly owned by Shalutai Buddhiwant, for not responding to notices, requesting it to set aside the ex-parte order

The National Consumer Disputes Redressal Commission (NCDRC) on Friday slapped a fine of Rs 1.5 lakh on Trishul Builders, partly owned by Shalutai Buddhiwant, who was a Congress MLA in the 1970s.

The commission fined the firm for not responding to its notice and then abruptly requesting the NCDRC to set aside the ex-parte order — which does not require all parties to be present — against them. The commission asked the amount — 75 per cent of which will go to the complainant and 25 to the consumer welfare fund— to be deposited in 30 days.

The developer had allegedly cheated 114 people of marginal income groups, who bought apartments at their Shalini Lake View project at Undri in 2007-08. In 2010, the under-construction building was razed by authorities as the land was revealed to belong to Pune zilla parishad and was reserved for a percolation lake. However, many buyers had already paid their downpayments and EMIs.

Meanwhile, Trishul Builders has changed its name to Tuksons Constro Pvt Ltd and is based out of Wanowrie.

The complaint in this case was filed by an NGO in May 2012. The aggrieved buyers are seeking a compensation of Rs 3.16 crore apart from Rs 2 lakh as litigation cost.

In spite of issuing notices, the respondent failed to appear before the commission for hearings over the past three years. The judges had then issued two ex-parte orders in July 2014. When the commission was about to issue its final order in favour of the buyers, the respondent filed a plea to set aside the order as they appeared before the commission.

Speaking to Mirror, Shrikant Joshi, legal head of Akhil Bhartiya Grahak Panchayat, which filed the complaint, that Buddhiwant and two others had filed the plea on August 13. "Considering their approach prior to filing the plea, the judges slapped a fine of Rs 1 lakh on Buddhiwant and Rs 50,000 on Kasim Shaikh and Lukman Khan, who are co-proprietors of the firm."

According to the complaint, the firm had advertised on their website and through newspapers, hoardings, pamphlets about their schemes like Shalini Lake View, Shalini Heights, Shalini Gardens, Shalini Hill View, etc. It is alleged that they carried misleading advertisements and attracted buyers by furnishing false information.

"We had paid down payments and have continued paying the EMIs with the belief that we will take possession of the flats in March 2011 We received no home and not a single penny," said Dr Razak Shaikh, one of the complainants.

As per provision of the law, the exparte order was set aside and the next hearing scheduled for October.
